The policies and guidelines expressed herein supplement the rights and
obligations of the parties under the Service Agreement of even date.
This
document establishes operating principles and acceptable use policies as they
relate to the Customers use of the Internet and the connection/services
provided by CyberTech to the Customer under the Service Contract Agreement.
General
The Internet is a voluntary association of users interested in and willing
to exchange information and data with other Internet users. At present there
is no oversight group providing governance over the principles, policies or
procedures for use of the Internet or the information and data accessed via
the Internet.
In order to facilitate their contractual relationship the Customer and
CyberTech wish to define a working protocol of principles and policies and
establish operating guidelines and acceptable standards of use of the Internet.
To this end the parties agree as follows:
Principles Governing Acceptable use of the Internet by the Customer
a) Responsibility and Respect - The Internet is a network intended for
use by mature, adult users. The Customer recognizes this principle and
undertakes at all times to act with respect, courtesy and responsibility,
giving due regard to the interests and rights of other Internet user groups.
This general guideline carries with it the following specific
responsibilities:
b) Knowledge of the Internet - The Customer agrees to obtain a basic
knowledge of the Internet and its operating principles and procedures.
c) Improper Uses - The Customer will avoid violation of certain generally
accepted guidelines on Internet usage such as restrictions on mass mailings and
mass advertisements, pirating or copying of software, mail bombing or other
methods of attempting to deny service or access to other users, and attempts to
violate security.
d) Compliance with Laws - The Customer will ensure that its use of the
Internet complies with all applicable federal, state and local law and
regulation, including but not limited to those principles of law which protect
against compromise of copyrights, trade secrets, proprietary information and
other intellectual property rights, libel or defamation of character, invasion
of privacy, tortious interference, and export of technical or military data to
prohibited countries.
e) Validation of Information - The Customer is responsible for validating
the integrity of the information and data it receives or transmits over the
Internet.
f) Security - The Customer is required to protect the security of its
Internet account and usage. The Customers password will be treated as private
and confidential and not disclosed to or shared with any third parties.
g) Discretion and Judgment - The Customer is expected to use discretion in
the treatment and handling of Internet information and data and to take
particular care to insure that adult information is not transmitted to
juvenile users of the Internet.
h) Excessive CPU usages - Customers will not be allowed to use excessive
amounts of CPU processing on any of our servers or face immediate suspension.
For example: 1) a few customers have tried re-selling our counters or
auto-responders to the rest of the world which caused an excessive amount of
requests on our server(s). 2) email bombs. 3) re-selling CGI access to other
3rd parties
i) Pornography - We adhere to U.S. laws and regulations regarding Illegal adult-related material of any nature.
j) SMTP - Email Address -
We are not an ISP but a Web Hosting Provider and we do not provide SMTP access. You must have an email address with your local ISP to use our services.
We will provide you with POP3 email or forwarding Email through your website.
It is a privilege to use our sendmail application to send mail from your webspace to the outside and this privilage can be revoked without warning as in paragraph k).
k) Spamming - We adhere to U.S. laws and regulations regarding email
spamming. We do not accept any kind of spamming on servers. Customers that want
to bypass our preinstalled cgi-scripts (fmaill) by using the unix sendmail
application MUST request FIRST our approval and fax us this document duly
signed.
At the first spamming complaint we will remove the customer the
authorization to use the sendmail application.
l) Resale of services - Customers may resell web space within their own account, but are responsible for the entire domain site content. Customers may not resell mail services including, but not limited to mail forwarding capabilities, POP accounts and autoresponders. The customer may not at any time resell access to, or use of, CyberTech's preinstalled scripts including, but not limited to newcount, imagemap, htimage, cgiemail as well as any custom or personally owned scripts for use by a third party while installed on the web server.
m) Set-up fee and first payment are due at the time the application is filled out, and returned to CyberTech. Subsequent payments are due according to the selected fee schedule following the establishment of the web space on the Internet. Web space will be billed a minimum of one (1) month in advance depending on the selected fee schedule. Subsequent payments are due on the 5th day of each month as per the selected fee schedule. In the event that the Customer fails to pay for such services and or setup in advance, CyberTech shall be entitled to unilaterally terminate this Agreement and discontinue the service until payment is made.
Be aware than setup fee only cover the setup of your website on our servers but not the setup of your html pages nor the setup of your emails. We will be happy to do additionals setup for you. Ask for a quote!
n) The application and this Agreement constitute a binding contract between CyberTech and the Customer and does not extend to any other person or entity. Customer may resell to third parties but is responsible for third party activities and content, and is bound by the terms under this Agreement. Cancellations after the application is received and webspace is set-up will still hold the Customer responsible for costs incurred by CyberTech concerning the set-up of the web space.
Unless cancellation by customer before the end of running contract period, the initial contract will be reconducted for the same initial lenght with same initial monthly fees and same initial ways of billing.
No refund for unused and pre-paid period will be done if customer decides to discontinue services (web hosting or others) with CyberTech before the end of the said period.
Cancellation will only be accepted by mail or express mail duly signed by the owner.
Cancellation by fax or/and email will NOT be accepted.
It is the client's responsibility to point their domain(s) to another service provider upon termination, cancellation or discontinuation of service.
